What are the issues for attorneys representing non-U.S. citizens in criminal and civil cases? Topics we will cover in the first hour include: determining if your client is deportable, negotiating plea agreements in light of potential immigration consequences, preserving immigration defenses, the obligations of prosecutors, and an analysis of Padilla v. Kentucky and Zemene v Clark regarding the ethical obligations of attorneys to provide diligent representation. The second hour panel discussion will open the floor to broader topics including the impact of immigration enforcement on both civil and criminal cases, and the status of  DACA (the “Dream Act”), and its potential impact on client representation.
