The program will encompass a thoughtful panel discussion on how best to build and preserve the necessary record of error in the trial court for later appeal and strategies to prepare and make a winning argument in the proper appellate court. Approximately half of the program will be devoted to practical considerations in planning for and conducting the trial with an eye on an appeal in both state and federal court. Common mistakes in failing to preserve error will be discussed in detail. The remaining half of the program will focus on strategies for preparing the appeal and making an effective argument. The panel will emphasize key points involved in briefing and making a persuasive oral argument (e.g. anticipating the hardest questions, focusing on “must-make points”).
